For the purposes of these Terms and Conditions 'We', 'Our' and 'Us' refers to LetMeDirect.com. Please review these Terms and Conditions carefully before using this Website.
By using or accessing this Website (whether as a guest or a registered user) you confirm your agreement to these Terms and Conditions. Your use of this Website is at all times subject to these Terms and Conditions (which form a legally binding contract between LetMeDirect and you) and all applicable laws. If you do not agree to these Terms and Conditions, do not use this Website.
These Terms and Conditions apply to the services available from www.LetMeDirect.com and any of its current or future sub-domains (the "Services"). We reserve the right to change these Terms and Conditions from time to time. Any such changes will be displayed on this Website. Your continued use of this Website following such changes will be deemed to be your acceptance of such amended Terms and Conditions. If you do not accept any such changes, you should stop using this Website.
Data Protection
Save as provided elsewhere in these Terms and Conditions or as expressly agreed otherwise, any personal information you supply to Us when you use this Website will be used in accordance with Our Privacy Policy.
When a tenant enquires about a property, We will forward their details to the respective landlord. We will forward all their contact details to the landlord including any pre-screening questions answered on the form the tenant is required to complete when applying for a property.
Property Rights and Use of Material
All trademarks, copyright, database rights and other intellectual property rights in the materials on this Website (as well as the organisation and layout of this Website) together with the underlying software code and any other information provided to you in the course of the receipt of any Services, are owned or licensed directly by Us. Without Our prior written permission, you may not copy, reproduce, reverse engineer, modify, create derivative works from, publish, transmit, distribute, or otherwise publicly display, or sell or transfer any material on this Website or the underlying software code or any other information provided to you in the course of the receipt of any Services, whether in whole or in part. However, a single copy of the contents of this Website may be downloaded, printed or copied for your personal non-commercial use.
If you breach any of these Terms and Conditions, your permission to use the materials on this Website and any other information provided to you in the course of the receipt of any Services, automatically ceases and you must immediately destroy any copies you have made.

- Cancel your advertisements without reference to you;
- and/or Deny you access to this Website
where we believe (in Our absolute discretion) that you are in breach of any of these Terms and Conditions.

This Website may include links to other internet sites. We do not endorse any such websites and We are not responsible for the information, material, products or services contained on or accessible through those websites. Your access and use of such websites remains solely at your own risk.
Limitation of Liability
Save as provided elsewhere in these Terms and Conditions, to the maximum extent permitted by law, We exclude all warranties, conditions or other terms, whether express or implied, whether by statute, case law, custom or otherwise in relation to this Website or any Services, including without limitation as to satisfactory quality, fitness for particular purpose, non-infringement, availability, compatibility, accuracy or completeness.
You acknowledge and agree that:

In the event that you purchase or obtain any goods or services from a third party then your acquisition of such goods or services will be in accordance with the third party's terms and conditions and LetMeDirect.com will have no liability to you in respect of the same.
You agree that LetMeDirect.com has not conferred by implication, or otherwise, any licence or right under any patent, trademark or copyright (except as expressly provided) of LetMeDirect.com or of any third party.
Indemnity
This You agree to indemnify, defend and hold Us harmless from any liability, loss, claim and expense (including reasonable legal fees) related to your breach of these Terms and Conditions.
Events beyond our control
We will not be in breach of these Terms of Use, or otherwise liable for any failure or delay in performance, arising from any circumstances beyond our reasonable control including, without limitation, strikes, lock-outs and other industrial disputes, breakdown of systems or network access, flood, fire, explosion or accident.
Pricing and Title policy
We provide an advertising service rather than a physical product. We do not offer a refund as once you have confirmed the content of the listing and purchased a service the advert will be made live.
We make every effort to ensure that the pricing displayed on our website is correct.
However, if an error in the pricing of a product is found we reserve the right to either cancel your order or contact you to arrange payment of any extra sum due or refund any over-payment made by you (as applicable).
The processing of an order can be cancelled or corrected by us at any time up to the fulfilment of that order and any related items.
We reserve the right to alter all product pricing without notice, but we will wherever possible ensure that the price displayed is what you pay for. Always check the price at the checkout before proceeding as this is the price payable.
Title in any products ordered from us does not pass to you, the purchaser until we have received and processed a valid payment, and that payment has been made into our own bank account and your order has been fulfilled.
The Order
When you place an order for a product or service you will automatically receive a confirmation email from us to confirm your order.
Your order constitutes an offer made to us to purchase the goods or services specified in the order.
Your offer is only accepted by us once we have emailed you to confirm the dispatch of or availability of your order.
Product or Services not included within the dispatch email are not included in the order and contract between you and us.
We reserve the right to delay or refuse orders where a transaction contains incomplete details or details that cannot be verified or where fraud is suspected.
If we are unable to reasonably ascertain these details or resolve these issues a full refund will be made against the card used at the time of purchase.
No other form of refund or credit will be offered nor will a refund be made to any third party card or account.
In all cases We reserve the right to make a refund or not.
When You (Landlord) Register your Property
In registering your property with Us and/or by ticking the relevant button(s) within the Property Wizard and Landlord Dashboard pages of Our website you the Landlord agree that;
You have fully understood the marketing, letting and property management service that we provide.
You agree that our service is satisfactory for your needs.
You agree to pay in full before your property is included within our marketing service.
You have fully understood and agree to all aspects within our Terms and Conditions.
You agree to use our service as a landlord only and not as a letting agent or estate agent.
If it is found that you are a Letting Agent or Estate Agent your property will be immediately withdrawn from our site and services and no refund will be made.
You agree that we cannot guarantee that your property will be let by using our services and that no refund will be made in the event that your property is not let.
We will market your property according to the number of days per marketing packages available or until you have secured a suitable tenant - whichever comes first.
The property will be unpublished after the stated timescales, however we will notify you in advance of this, giving you the opportunity to extend the package
Should the landlord wish to continue to market the property, a further fee will become payable at the rates advertised at the time
Package Features Included
When you purchase a marketing package for your property, you as the Landlord agree that the information they provide is 100% accurate and that the property details comply with any legislation that governs the description of property, currently known as Consumer Protection from Unfair Trading Regulations 2008. Previously it was known as the Property Misdescription Act 1991.
Once You created and approved the property particulars and the You have paid for the package in full, the property will be included on our site and partner sites. We also reserve the right to include, but not guarantee:
Property details will be sent to our database of registered Tenants who are seeking similar properties and who have provided us with consent to contact them via email / SMS.
The property will feature on the LetMeDirect.com website and all other websites that we market our properties through - subject to approval.
We will continue to actively market the Landlord’s property until either a) you have secured a suitable tenant or b) up to a maximum period as per the chosen marketing package
When You log into your account, you will be able to access various letting services / resources such as creating a tenancy agreement, referencing a Tenant, ordering a To Let board, ordering EPC’s Gas Inspections, Floor Plans etc.
Some of these services incur an extra charge which are payable via the dashboard and the charges are made visible to the Landlord.
Prospective Tenants who wish to make an enquiry regarding a certain Landlords’ property will be required to complete an on-line application form Free of Charge which We will process and forward to you once the enquiry has been pre-screened against your set criteria.
We will register all enquiries and contact You via email & SMS as soon as possible after receiving the enquiry. We are a 24/7 letting service, so enquiries are sent 24 hrs a day 7 days a week, via our dedicated enquiry management system. We are not responsible for the information supplied by prospective Tenants or third parties.
The Tenant will be asked to contact you through their account to book viewings and we may ask them to contact you Directly where the Landlord is conducting their own viewings.
We are able to offer an accompanied viewing service at an additional cost and subject to agreement and availability of appointment slots.
Rental Property Postcodes
When a registration is sent to our list of partner sites the correct postcode must be included within the information that is sent.
If it is found that an incorrect postcode or a postcode that is not registered with the Royal Mail has been sent to our partners websites the postcode and the property will be rejected from the partners website and the property will be excluded from marketing until the postcode is deemed as correct by the particular website or the postcode can be found within a Royal Mail search.
LetMeDirect.com are not responsible for the rejection of any property registration due to the incorrect or unregistered postcode that has been given by a Landlord.
All of our marketing websites/portals locate the exact location of a rental property by the postcode of the property.
Our marketing websites/portals have the final say on where a property is located, and within what property searches individual rental properties will show.
This judgement is made by our marketing websites/portals using their own map facilities and the postcode offered by LetMeDirect.com.
At no time are LetMeDirect.com to be held responsible for an individual rental property not showing in the desired area search due to our marketing websites/portals locating the individual rental property in an area outside the preferred location
Letting Services / Resources
Both the Landlord and Tenant must use the letting resources provided by LetMeDirect.com and any third party suppliers servicing the package purchased.
For Example the services are (but not limited or guaranteed):
Tenancy Agreements and Legal Documents
LetMeDirect.com tenancy and general license agreements are created under license and copyrighted.
We regret that neither LetMeDirect.com nor the licensor are able to provide general or legal telephone advice.
We take every care and attention to ensure that the agreements comply with current housing act and non housing act regulations.
LetMeDirect.com cannot be held responsible where an incorrect agreement has been used by a Landlord to let a property.
All agreements and forms that have been provided by us and sent to the Landlord for completion by the Landlord and Tenant are to be used as a tenancy agreement guide only.
Should the Landlord or Tenant wish to include further considerations within the agreement that is entirely the responsibility of the Landlord and Tenant and not LetMeDirect.com.
We will not be held liable for failure of any part of any agreement that the Landlord has ordered from us
Energy Performance Certificated (EPC’s)
Energy performance certificates are a legal requirement for all Landlords that market property to let in England and Wales.
Landlords that order an EPC from LettingaPorperty.com will receive a call from an energy assessor representative normally within 48 hours of placing the order.
LetMeDirect.com acts only as an introducer to a third party supplier and therefore cannot accept responsibility for any works carried out by the Energy Assessors.
The Energy Performance Certificate complies with latest property and energy regulations.
Gas Safety Certificates
LetMeDirect.com acts as introducer of third party suppliers in the provision of Gas Safety Certification.
In line with current Gas Safety Regulations, all our Gas Engineers comply with GAS SAFE standards.
Identification and registration information can be supplied on visit.
LetMeDirect.com cannot accept responsibility for any works carried out by the Gas Engineer
Tenant Referencing Services
Tenant referencing is carried out by both third party referencing agency and LetMeDirect.com Tenant Referencing Team
We will apply for an employment reference, a current or previous landlord reference as well as a 6 year financial check, together with Electoral Roll Verification and Linked Address checks are also carried out when a Landlord uses the real-time online Credit Check facility
The cost of the Tenant Reference check is per tenant for comprehensive tenant referencing is paid by either the Landlord or Tenant as set out when You create your property listing, unless the property is located in Scotland in which case referencing is a Landlord associated cost.
If a reference request by the landlord is received within 15 days of the request and has passed on the agreed terms set out at the beginning of the process, the tenant may be reimbursed by the landlord if the landlord decides not to proceed where no fault can be attributed to the Tenant.
Tenants have limited days to complete and submit the application form from the time and date they receive it. They are advised by LetMeDirect.com when the offer is valid to, otherwise the property will be offered elsewhere. No Fees are payable by the Tenant until a Full Referencing Application is made
References must be finished and completed by the Tenants referees within the given period of time from receiving the offer to apply from the Landlord, Otherwise the property will be offered elsewhere.
If the Tenant fails the reference checks, no refund will be offered for the referencing fees.
LetMeDirect.com will not reimburse any reference fees where the application has already begun. The application process begins as soon as the application form has been submitted and a payment made. We are a 24/7 Letting Service.
TO-LET Boards
Most of our packages include a ‘To-Let’ board which complies with local authority planning regulations. You have the option not to include a ‘To-Let’ board, but no discount will be made when purchased as part of a package.
All To-Let board display the companies website address and may only be purchased by a Landlord that is actively marketing the property on Our website.
LetMeDirect.com will not act upon tenant enquiries as a result of a to-let board if the property in question is not actively being marketed on the company's website.
If a tenant at the property refuses a ‘To’Let’ board to be erected, the service will be marked as ‘refused’ and no refund will be made. If you reinstruct the board service then the price charged at the time will be payable in advance, through the Landlord Dashboard.
As the To-Let board is made to order, LetMeDirect.com will not accept returns unless the board is faulty and we are notified within 7 days of receipt, where the Landlord has requested a postal board service. Otherwise all boards are erected by a professional board erection contractor
LetMeDirect.com will not be responsible to remove the To-Let Board from the premises, unless the service includes removal.
The use of the To-let board is the responsibility of the Landlord and the Landlord should ensure they are permitted by local and planning laws to be able to display a ‘To’Let’ board.
Landlord and Tenant Insurance
LetMeDirect.com are FCA Introducer Appointed Representatives and refer all insurance enquiries to to various insurance brokers, who’s details are made available when completing the on-line form.
The insurance brokers are all authorised and regulated by the Financial Conduct Authority. In order to provide a better service to you, your details will be shared by LetMeDirect.com to Insurance Brokers only and visa versa.
Property Misdescriptions Act 1991 / Consumer Protection from Unfair Trading Regulations 2008
LetMeDirect.com are not responsible for the information supplied by the Landlord and it is entirely the Landlords’ responsibility to make sure that all personal and property particulars held by us are correct.
We hold no responsibility for any mis-descriptions that have been provided by the Landlord.
In agreeing to our terms and conditions the landlord accepts all responsibility for the particulars produced within the LetMeDirect.com website and all marketing resources used by us.
If a Landlord wishes to change any personal or property particulars they must do so by signing into their Private Account and editing the property. We will then notify all prospective tenants who have expressed interest in the property that the details have been updated
Suspicious Property Listings
If it is found that a property has been registered for any reason other than to find a prospective Tenant, the property will be removed from the LetMeDirect.com service straight away and no refund will be offered.
LetMeDirect.com reserve the right to suspend any rental advert until further notice if it is deemed by LetMeDirect.com that a registration has been placed within our services under misleading circumstances.
In the event that the landlord has more than one available property, the appropriate number of marketing packages must be purchased. The landlord cannot market more than one property unless they have purchased a package for each property.
If we believe the landlord is using one property to let another, the property will be removed and no refund will be given.
Property Viewings
All viewings on Landlords’ properties that are advertised on our site are to be carried out by the Landlords themselves or a representative of the Landlord unless otherwise specified.
We are able to offer accompanied viewings on all of our services at an additional cost, subject to availability and agreement.
Refund policy
We provide an advertising service rather than a physical product. We do not offer a refund as once you have confirmed the content of the listing and purchased a service the advert will be made live.
Descriptions
It is entirely your responsibility to make sure that all personal and property particulars held by Us are correct. We are not responsible for any mis-descriptions that have been provided by you. Your property description will be built by using Our Listing Wizard by utilising descriptive content selected / supplied by you.
If you are a landlord, you may not upload any corporate or other logo, image or brand identifier to your property description or include the same in any image you submit to Us. Similarly, you must not include your phone number, website address or email address to your property description, where free text is allowed on the site. Breaches in these terms will result in the descriptions being edited by LetMeDirect.com or the property being withdrawn of the site. LetMeDirect.com reserves the right in its absolute discretion to delist an offending landlord's properties from the Site without offering a refund.
Property descriptions are built by you, using our revolutionary Listing Wizard and all you need to do is select specific locations in the property (rooms etc) and the feature to each location. Our Listing Wizard will create a description at the end of the listing process. You will be allowed to preview this and confirm that you accept the description prior to activating and paying for the listing. We recommend that you include a minimum of one usable photograph of each location of the property, together with features in each location, as this will help describe your property to its full potential.
If there is a description not available for your property, you may request that we add a description, by completing the online request via your dashboard. We reserve the right whether to accept your request and add the description globally on our site. The description you request will be available to all other users of the site. If we are unable to add the description and you have created and paid for a listing, you will not be able to request a refund.
We will supply to each property portal on which We advertise your listing the maximum number of images allowed by each major portal and for all other portals We reserve the right to limit the amount of images but We will never supply less than four images (unless you send us fewer than four usable ones). The quality of the images appearing on third party portals may be reduced as many of them only allow low resolution images.
Landlords may not use tenant enquiries acquired via the Site to generate interest or further enquiries by any means or method for properties not listed on the Site by the landlord. LetMeDirect.com reserves the right in its absolute discretion to delist an offending landlord's properties from the Site without offering a refund.
Landlord & Tenant disputes
Any dispute that arises between a landlord and tenant who have used Our service will be resolved solely by the landlord and tenant. We are not responsible and shall have no liability for any disagreements or disputes that may arise throughout a tenancy term, including deposit disputes, which must be resolved using the relevant dispute resolution service in relation to the dispute.
Landlords' responsibilities
You accept sole responsibility for the legality of your actions under laws applying to you and your property and the legality of any items you list on this Website. In particular (but without limitation), save where LetMeDirect.com has expressly agreed to provide the same as part of any Services subscribed for and separately paid for by you, it is Your responsibility to ensure that all of the following are adhered to in relation to your properties listed on the Website:
- Where applicable, a current landlords' electrical safety certificate is in place
- A current landlord's gas safety certificate is in place, in accordance with Gas Safe Regulations and HSE Guidelines taking account of Landlords duty of care responsibilities.
- Where applicable the landlord must have permission from the mortgage lender to let out his/her property and provide proof to the tenant should they request.
- Adequate and correct insurance is in place to cover all eventualities of let property and that all furnishings within the landlords' property pass Fire Safety Regulations 1998 and provide proof to the tenant should they request
- All tax that is due from rental income is declared to the Inland Revenue no matter if the landlord is resident in the UK or overseas and should the Landlord be an overseas Landlord then the appropriate exemptions are applied for mitigating liability for tax deductions from both the tenant and Us.
- Where applicable it is advised that standing order payments are arranged by the tenant to allow for rental payments due from the tenant the Landlord
- Where applicable a rent book is given to the tenant to register weekly rental payments
- All utility bills are transferred into the current tenants' name
- Council tax payments are made by the current tenant, unless the property is exempt
- The tenant(s) deposit has been placed in a suitable tenancy deposit scheme as authorised by legislation, or the landlord holds the tenant(s) deposit and has ensured the tenant(s) deposit via a suitable tenancy deposit scheme. - A valid energy performance certificate (EPC) is obtained and a copy provided to Us within 7 days of listing a property on the Website. If We do not receive a completed EPC within a further 14 days of listing or if it is not shown here: www.epcregister.com , We reserve the right to remove any property listed and We will not be liable to make any refund.
We reserve the right to reject, at our sole discretion, any property listing even if we have acknowledged receipt of payment and taken payment from you if you have asked or requested from potential tenants any money before signing a contract, save for reservation of the property or referencing purposes as offered via the LetMeDirect.com website.
Landlords' HMO and Licensing Obligations
It is landlords' obligation to ensure compliance at all times with the provisions of the Housing Act 2004 (the Act) (including any secondary legislation, orders or regulations made under it) related to the licensing of HMOs and the terms and conditions of any applicable licence granted pursuant to the Act. Landlords acknowledge and agree that LetMeDirect.com shall be under no obligation to comply with the Act notwithstanding that LetMeDirect.com may by virtue of its property management services be a ‘person having control' over, or a ‘person managing', an HMO within the meaning of section 263 of the Act. Further, landlords hereby indemnify and shall keep LetMeDirect.com fully and effectually indemnified against any non-compliance of the Act by them as landlords including as to any costs damages expenses fines and/or penalties suffered or incurred by LetMeDirect.com in connection with any such non-compliance.
Editing and deletions
If you wish to amend any details about your property or personal particulars please log into your online landlord dashboard, using your username and password in the first instance; alternatively, you can email all amendments to support@LetMeDirect.com with your request. We endeavour to change all email addresses within 24 hours of processing your email request. Notification will be sent to both current and new email address together with SMS notification where able. It is your responsibility to ensure you keep safe user names and passwords as We will not be liable for any actions taken on your account, where unauthorised use has taken place due to negligence on your part on the safekeeping of log in details.
We reserve the right to remove property listings from this Website and other property sites fed from this Website if we have reasonable cause to believe the property is no longer available for rent. We will use reasonable endeavours to notify you by email prior to such removal. Properties listed under listing subscriptions where validity is for a set period of time will be removed at the end of the listing period. We will use reasonable endeavours to notify you by email / SMS prior to such removal. Therefore it is essential to keep your contact details up to date.
If a user reports a mis-description in your property listing, we reserve the right to remove the relevant listing from this Website and to contact you to request confirmation that the advert is correct. Upon receipt of such confirmation, we will decide, at our sole discretion, whether to re-instate your advert. No refund will be payable to you where your advert is removed in accordance with this process and an Administration charge will be payable at £30.00 + VAT.
If you wish to remove an advert this can be carried out by logging into your online landlord dashboard, using your username and password and deactivating the listing using the property status options.
Once a property has been removed from this Website we are unable to advertise the property again unless payment has been received in full for a new listing, which you can action via the landlord dashboard, unless proof can be supplied that the listing was removed in error. Re-listing in this case is at the sole discretion of Us and no refund will be made.
Data feeds
To ensure Our rental properties are showcased across the internet as fast as possible, you agree that We may use an automated feed system to send details of properties you list on this Website to Our carefully selected partners' websites ("Partners' Websites"). If you have any queries regarding Partners' Websites, please contact Us at support@LetMeDirect.com.
We do not guarantee that any property you list on this Website will be displayed on Partners' Websites and We are not be responsible for any technical problems relating to Partners' Websites. You acknowledge that your use of Partners' Websites will be subject to the terms and conditions set out on the relevant Partners' Website.

Fees
You will pay us the applicable fee listed on this Website (as amended from time to time) at the time of your order of the relevant Services, plus any applicable taxes, including any Value Added Tax. Fees are payable in GBP (pounds sterling) using Barclaycard payment gateway via this Website at such frequency as listed on this Website in respect of the relevant Services. We may choose to temporarily change the fees for Our Services for promotional events or new Services and such changes are effective during the period set out on the relevant page of this Website.
Fees are to be collected upfront by debit/credit card for Property Listing and any standard Tenancy Administration, Tenant Credit Check Package and associated legal and marketing services. LetMeDirect.com reserves the right to charge either yourself or the tenants as setup by yourself fees in respect of referencing at the rate displayed online, per tenant reference required (each tenant is referenced individually and if there is a guarantor involved as well they are also referenced and charged a fee as displayed online as applicable). All tenancy agreements will be drawn up using LetMeDirect's standard tenancy agreement and on the basis of the information supplied by the landlord. All tenancy documentation is supplied in a .pdf format for you to download and print. LetMeDirect.com does not hold any responsibly for any errors in the agreement due to faulty or missing information that either the Landlord or the Tenant has or has not supplied. As per 'landlord responsibilities' LetMeDirect.com accepts no responsibility for gas safety, electrical safety, EPC’s and such legal responsibilities and in particular it is not our responsibility to ensure that a valid gas safety certificate is in place before initial occupation.
LetMeDirect.com will not carry out Rent Collection Services on behalf of the Landlord, unless expressively agreed by Us.
LetMeDirect.com will not carry out property management services in conjunction with any of the services, but may offer services via other companies or individuals, to carry out this service on Your behalf. LetMeDirect.com will carry out the Listing of the property on the basis of the information supplied by the landlord. LetMeDirect.com is not responsible for any errors or misrepresentations in the information provided by the landlord to a tenant or vice-versa.
Your property will be advertised until let for a maximum period as set out in the marketing package purchased from the listing date after which time We reserve the right to either extend, remove the listing or request a further up front listing fee be paid at a monthly charge of £80.00 plus VAT until such time as you either pause your listing or advise us to stop advertising your property.
LetMeDirect.com may telephone or email you with offers of additional services which We offer. If you request additional services. We will follow-up that telephone call with an email to confirm your wish to purchase those services and send you periodic invoices once We have started providing the services to you. If you indicate your wish to purchase services online via this Website, We will send you a confirmation email and send you periodic invoices once We have starting providing the services to you, these may be in the format of updating your account within your dashboard.
You agree that We will only supply you a Service once you have activated the listing, agreed to these terms and conditions and paid for the Service(s) you want. These Terms and Conditions apply to any additional Services which you may order from Us.
We reserve the right to reject, at our sole discretion, any property listing even if we have acknowledged receipt of payment and taken payment from you.
Any discount code or gift voucher supplied to you by any of Our affiliates which may entitle you to purchase Our services at reduced cost must be used at the time of purchase and will not be accepted retrospectively. Exact details of discounts or gift vouchers will be detailed on the specific code / voucher. We reserve the right to limit the number of discount vouchers per transaction, under a one offer per transaction term, or remove the promotion without notice.
Scottish Properties
If you are the landlord of a property in Scotland, you should note that your tenant may not be charged fees for our services and so you will be liable to pay all Our fees including for example, in relation to tenant referencing which might otherwise be payable by them under these Terms and Conditions. You should therefore ensure that you select that You (Landlord) will pay any administration, contract or referencing fees that are applicable to your property. At the time that the tenant completes their referencing application a request for payment will be sent to you, which you can access via your Dashboard and payment can be made by selecting the pending/respective reference request. Once payment has been received the referencing process will commence. If you do not comply with this legislations requirements, we reserve the right to remove the property from the site without any refund.
Limitation of Liability for Services
We shall not be liable for any failure in, or delay in, performing the Services to the extent directly prevented or delayed by;
- any information and documentation provided to Us by you or on your behalf or by any of your tenants in relation to the Services
- any instructions provided to Us by you or on your behalf or by any of your tenants being materially incomplete, inaccurate, illegible, out of sequence or in the wrong form, or arising from their material late delivery or non-delivery
- any failure by you to comply with your obligations as expressly set out in any description of the relevant Services listed on this Website (as amended from time to time) (the "Services Description")
- any act or omission by the tenants of your property. It is your responsibility to procure that your tenants cooperate with Us to allow Us to provide the Services. We reserve the right not to deal with uncooperative tenants and to suspend Our Services in relation to an affected property altogether or for such period as We in Our absolute discretion shall determine.
For the avoidance of doubt, We shall have no liability (including without limitation to you or to any of your tenants) in respect of safety certification.
We do not limit liability for fraudulent misrepresentation or death and personal injury arising from Our negligence. We (including Our affiliates, officers, directors, agents, subcontractors and employees) will not be liable to you in contract, tort (including negligence) or otherwise for indirect or consequential loss incurred or suffered by you or any third party (including without limitation any of your tenants) in connection with the receipt of any Services. Subject to the forgoing, to the maximum extent permitted by law, Our (including Our affiliates, officers, directors, agents, subcontractors and employees) aggregate liability, whether in contract, tort (including negligence) or otherwise for any loss incurred or suffered by you or any third party (including without limitation any of your tenants) in connection with the receipt of any Services is limited to the amount of any Fees paid by you in respect of the relevant Services.
Termination
Our provision of any Services is subject to your payment of the Fees in accordance with these Terms and Conditions. We may terminate any Services provided to you at any time on not less than 7 days notice. We may terminate/deactivate any Services provided to you immediately by notice in the event that any amount payable by you under these Terms and Conditions has been recalled by the merchant service provider or your payment has failed and any outstanding balance will become ‘payable immediately’, failure to do so will result in the listing being deactivated until such time as the Service is paid for and We reserve our rights of recovery plus costs for the outstanding balance.
Property Management / Rent Collection
We do not offer any Property Management or Rent Collection Services at present, but should you require this service, we are able to offer this service across the Midlands Region by separate arrangement, though our affiliated property management consultants.
